These Terms and Conditions govern access to and use of all photographic images, video footage, visual content, graphics, captions, metadata, text, audio-visual materials and related content (collectively, the “Content”) available through gallery.thepictures.uk and associated services operated by The Frontline Media Group.
By accessing, viewing, downloading, licensing, purchasing, storing, reproducing, publishing, transmitting or otherwise using any Content, you acknowledge that you have read, understood and agree to be legally bound by these Terms and Conditions.
If you do not agree with these Terms and Conditions, you must not access or use any Content.
1. About ThePictures.uk
ThePictures.uk is a visual content licensing platform operated by The Frontline Media Group, an independent British journalism, documentary and media publishing business operating under the laws of England and Wales.
ThePictures.uk provides access to original editorial photography, documentary imagery, video content and related visual materials created by The Frontline Media Group and its contributors.
2. Ownership of Content
All Content made available through ThePictures.uk is protected by copyright, moral rights, database rights and other intellectual property rights under the Copyright, Designs and Patents Act 1988, the Berne Convention, international copyright treaties and applicable laws worldwide.
Unless expressly stated otherwise in writing:
All copyrights remain the exclusive property of The Frontline Media Group and/or the respective contributor, photographer, videographer or rights holder.
No ownership rights are transferred through any licence, invoice, agreement or purchase.
All rights not expressly granted are reserved.
The purchase or licensing of Content grants only the limited rights expressly specified in the applicable licence.
3. Permitted Use
Content may only be used in accordance with:

Any applicable licence agreement;
Any invoice issued by ThePictures.uk;
Any usage restrictions communicated by The Frontline Media Group;
Any metadata, captions or rights notices associated with the Content.
No rights exist beyond those expressly granted in writing.
4. Editorial Use
Unless expressly authorised in writing, Content is licensed solely for legitimate editorial use.
Editorial use includes:

Journalism;
Documentary publications;
Educational reporting;
Public-interest reporting;
Commentary concerning newsworthy events, people, issues or places.
Editorial use does not include advertising, marketing, endorsements, fundraising, political campaigning or promotional activities.
5. Commercial Use Prohibited Unless Licensed

6. Governmental, Military and State Use Restrictions
No Content may be supplied, licensed, syndicated, distributed, sold, transferred, reproduced, republished, displayed, transmitted or otherwise made available to any governmental, military, intelligence, political or state-affiliated entity without the prior written consent of The Frontline Media Group.
This restriction applies to:

Regional governments;
Local authorities;
Ministries and government departments;
Armed forces;
Military organisations;
Intelligence agencies;
Security services;
Police and law-enforcement agencies;
Border-control authorities;
Publicly funded agencies;
State-owned enterprises;

International governmental institutions.
No agency, distributor, syndicator, reseller, archive, publisher, broadcaster, media partner, licensing intermediary or third-party licensee may authorise, facilitate or permit the use of Content by any such entity without prior written consent from The Frontline Media Group.
Any party that directly or indirectly enables, facilitates or authorises such unauthorised use shall be liable for all resulting damages, licensing fees, investigative costs, enforcement costs and legal expenses.
7. Prohibited Uses
Users shall not:
Use Content in any defamatory manner;
Use Content in any misleading or deceptive context;
Use Content in connection with unlawful activities;
Use Content in pornography or sexually explicit material;
Use Content in hate speech or discriminatory material;
Alter Content so as to misrepresent facts or events;
Remove copyright notices, metadata or credits;
Misrepresent authorship or ownership of Content;
Resell or sublicense Content without written permission;
Upload Content to stock libraries, archives or databases;
Use Content in connection with disinformation campaigns;
Use Content to train artificial intelligence systems.
8. Modifications
Content may only be cropped or reformatted where reasonably necessary for publication.
Users shall not:
Manipulate Content in a way that alters its factual meaning;
Create misleading composites;

Users must not disable, circumvent, remove or interfere with:

Any such interference may constitute a breach of copyright law and applicable anti-circumvention legislation.
11. Third-Party Rights

14. No Waiver
Failure by The Frontline Media Group to enforce any provision of these Terms shall not constitute a waiver of any rights or remedies.
15. Severability
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
16. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from or relating to these Terms, any licence agreement, invoice or use of Content.
Nothing in this provision shall prevent The Frontline Media Group from seeking injunctive relief, enforcement measures or legal remedies in any jurisdiction where infringement or unauthorised use occurs.
